Slide Boat Policies
Customer cancellations are subject to a 15% cancellation fee and must be given with 1 full day's notice before the scheduled rental to receive a refund. If a boat is unavailable at the time of rental, a refund can be issued by the manager if the customer cannot reschedule. Refunds will not be issued for partial rentals. Reservations may be canceled by NM Marina Management due to inclement or impending inclement weather. Boat rentals can be rescheduled to a different date/time slot with 2 day's advance notice, subject to availability. Time remaining on rentals cut short by dangerous weather conditions, as determined by NM Marina Management, can be credited towards a future rental. The future rental must meet the 3 hour minimum rental requirement. The credited time must be used in 1 rental.
By signing this boat rental agreement, LESSEE acknowledges and agrees to terms and conditions set forth in said agreement. LESSEE agrees that said craft will not be occupied by a greater number of people than stated in thisagreement. All malfunctions, breakdowns and accidents must be reported immediately. If LESSEE does not return theboat by the time specified in this agreement, LESSEE agrees to pay for OVERTIME AT DOUBLE THE REGULAR HOURLY RATE. LESSEE acknowledges his/her RESPONSIBILITY for the proper and safe use of the boat and the welfare and safety of their passengers and other boaters on the lake. LESSEE agrees to and understands that all damages that occur during rental are LESSEE’S responsibility and the cost of repair will be added to agreement and charged to provided Credit Card listed below upon return and Check In of the boat. Check In is not complete untilLESSOR inspects the boat for damage. LESSE may be present during inspection.
LESSEE further agrees to indemnify and hold harmless Marina Vista. and its agents against any and all claims; or
I (we) have read both the front and back of the agreement and fully understand the terms as set forth on both
sides and will comply with Marina Vista rental policy; that I (we) have received of a copy of this agreement.
Additional Terms and Conditions
LESSEE(s) further agrees to (continued from the front side of this agreement):
1) LESSEE acknowledges the boat rented has been carefully examined along with the all equipment and accessories and LESSEE finds them suitable for the purpose it is intended for.
2) LESSEE agrees to return rental boat in as good condition as it was when taken (ordinary wear and tear excluded). All damages to the rental boat and/or lost equipment is the responsibility of the LESSEE and will be applied to charges upon return of the rental boat. Marina Del Sur shall not be limited to its ability to seek further compensation for damages occurred.
3) LESSEE agrees to all rules, regulations and laws set forth by Marina Vista and State Parks of New Mexico, which include but aren’t limited to:
A) Rental boat will not be used in or for any unlawful purpose.
B) Rental boat must not be used in a careless or negligent manner.
C) Rental boat will only be operated by people who have signed the front side of this agreement.
4) LESSEE acknowledges that it is illegal to operate a vessel, or to permit others to do so, when under the influence of alcohol or drugs. Anyone being towed may not be under the influence of alcohol or drugs. Operating a vessel under the influence is punishable by a fine of not more than $1,000 and up to a year in jail.
5) LESSEE will maintain a proper lookout at all times for other boats, navigational hazards and weather. LESSEE has been told what the daily weather forecast is for today’s rental period.
6) Marina Del Sur, Inc. reserves the right to refuse service to anyone. Additionally, the agreement may be canceled by Marina Vista. due to inclement or impending bad weather or for any reason as deemed reasonable by Marina Vista.
7) LESSEE acknowledges that to tow a watersport participant, an observer (a person other than the driver of the vessel) must continuously observe the person(s) being towed. The observer must display a red/orange flag when the participant is in the water, preparing to ski/wakeboard/tube ride or has fallen. Watersports (waterskiing, tubing etc.) are prohibited from one hour after sunset to one hour before sunrise. ANY PERSON BEING TOWED OR PARTIPATING IN WATERSPORTS MUST WEAR A LIFEJACKET.
8) LESSEE acknowledges and agrees to his/her responsibility for the welfare and safety of their passengers and other boaters while on the lake. LESSEE agrees to operate the rental boat in a proper and safe manner. LESSEE understands and agrees that Marina Vista shall not be held liable for any inconvenience or lost time due to accidents, malfunctions or breakdowns of the rental boat (damages included).
9) LESSEE agrees to indemnify and hold harmless Marina Vista. from and against all claims including but not limited to: injury to persons (including death) resulting from the use, operation or possession of said rental boat and claims for lost or damaged property. Marina Del Sur, Inc. will be held harmless in regards to the LESSEEs personal property including but not limited to damage caused by fire, water, theft or any other cause whatsoever.
10) All expenses incurred in the collection or attempted collection of monies due in case of suit filed by Marina Vista against the LESSEE, including Attorney fees and/or liability in connection with the enforcing of this agreement and any and all damages, costs or losses will be LESSEEs responsibility. It is understood that the Venue for all actions hereunder shall be held in Sierra County located in the State of New Mexico, U.S.A.
11) Should the rental boat breakdown or malfunction, LESSEE is required to notify Marina Vista immediately. This includes any defect discovered after acceptance of the rental boat. LESSEE assumes all liability of injury to any and all persons and damage to property resulting from continued use.
12) All rentals and reservations are contingent upon and subject to the timely return of the rental boat by the previous LESSEE and all other causes beyond Marina Vista control including weather.
13) Should any term or condition of this agreement be held void or unenforceable, then that term or condition will be struck from this agreement and the remainder will not be affected and will remain in full force and effect.
14) For the safety and welfare of all who use the facility the LESSEE agrees to all rules and regulations contained herein and as posted in the marina. The LESSEE certifies that he/she has read both sides of this agreement and understands said rules and regulations. It is LESSEE’S responsibility to see that all family and guests obey all rules and regulations.
LESSEE agrees to all terms and conditions set forth on both sides of this agreement and understands that no other agreement has been made, verbally or written, that is not included in this agreement or posted at the marina.
LESSEE has read and understands both sides of this agreement.
